Class Actions
Our lawyers have substantial experience in prosecuting plaintiffs' class actions, particularly in the tax shelter and consumer protection areas. The class action vehicle allows an action to be brought by one or more representatives on behalf of all persons similarly affected by a defendant's conduct. In addition to other advantages, this often serves to protect the rights of unnamed victims against statutes of limitations and other bars. It also can provide a forum for the settlement of claims on a group basis subject to court supervision.
Deary Ray has recently filed a class action in Phoenix federal court, pursuing claims under the Class Action Fairness Act and the Racketeer Influenced and Corrupt Organizations Act (RICO) for the promotion and sale of "captive insurance" schemes, and has other class actions in process. Deary Ray attorneys also have experience defending class and collective actions, most notably in the employment arena where we have defended wage and hour and WARN act cases.
